Terms and Conditions
On this page you will find detailed information about my work and the methods I use. If you have any questions, I will be happy to answer them by email or telephone. Your feedback is very valuable to me as I continually work to improve my website and services. So don't hesitate to share your suggestions with me.
When booking an service you agree to HorizonEye's general terms and conditions, which can be found on this page.
These conditions apply to every offer, quotation and agreement between HorizonEye and a Client to which HorizonEye has declared these conditions applicable, insofar as the parties have not expressly and in writing deviated from these conditions.
Quotations and Services
Quotations are entirely without obligation, unless agreed otherwise. The service is described in the quotation. The assignment includes high-resolution videos and photos without watermarks. The prices stated in quotations are valid for 7 days. All prices stated in quotations include statutory taxes (VAT) within the Netherlands. After you have indicated by telephone or email that you wish to make definitive use of a quotation and this quotation has been signed and returned within 5 days of sending, the quotation becomes an agreement and the date in question is definitively put in the agenda and reserved. By signing the agreement, the client agrees to the rate and payment settlement date.
Article 1 General
Article 2 Delivery of images
After completion of the recordings, HorizonEye will deliver the edited drone images to the customer within 10 working days, unless otherwise agreed in writing. If the customer requires urgent delivery, this must be agreed in advance.
Delivery method
The drone images are delivered digitally by default via a download link, email, or a cloud storage service such as Dropbox, Google Drive, or a similar service.
Feedback and Approval
The edited images will be delivered within 10 working days after the date of the order, unless otherwise agreed. This is the first version to be delivered (V1), and this video will be sent in 1080P. It is now up to the client to review the video. If there is any feedback on the video, we will process this within 5 working days and then send a V2. When the video is completely satisfactory, the 4K video will be sent. An extra video is also added as a social media short, with the aspect ratio adjusted.
Article 3 Reservation and Cancellation
Customers can reserve services via our website, by telephone or by email. Reservations will be confirmed once the customer receives a confirmation message from us. No down payment is required for the services. The payment term will be stated on the agreement.
Cancellations by the Client
Cancellations can be made in writing (by email) or by telephone. Cancellations more than 7 days before the scheduled service are free of charge. For cancellations less than 7 days before the scheduled service, the customer is due 50% of the total amount. If the customer does not appear (unless otherwise agreed in writing) on the agreed date and time without prior cancellation, the full amount will be charged.
Cancellation by HorizonEye
HorizonEye reserves the right to cancel or reschedule services in the event of adverse weather conditions that may affect flight safety. In this case, no cancellation costs will be charged and a new date will be agreed.
In the event of force majeure, including natural disasters, pandemics, government actions, and other unforeseen circumstances beyond HorizonEye's control, we may cancel or reschedule the service without liability.
Article 4 Use of Recordings and Material
All recordings and materials (photos, videos, etc.) taken by the drone pilot remain the property of HorizonEye until full payment has been received by the customer. After full payment, ownership is transferred to the customer.
Use by HorizonEye
Unless otherwise agreed in writing, HorizonEye reserves the right to use the recordings and materials for its own promotional and marketing purposes, such as showing work samples on the website, social media and other marketing materials.
By agreeing to these conditions, the customer grants HorizonEye permission to use the recordings as described in Article 4. If the customer objects to the use of certain recordings, this must be indicated in writing before the start of the service.
Sensitive information
HorizonEye will take all reasonable measures to ensure that confidential information collected during the provision of services remains protected. Confidential information will not be provided to third parties without the customer's permission.
Preservation and Archiving
HorizonEye retains the original recordings and materials for a period of 6 months after the completion of the service, unless otherwise agreed in writing.
After the retention period, HorizonEye reserves the right to archive or delete the recordings. The customer is advised to make their own backups of received recordings and materials.
Liability
HorizonEye strives for the highest possible quality, but cannot provide an absolute guarantee with regard to color, clarity or other visual aspects of the recordings, which may vary due to technical limitations and external circumstances.
Article 5 Weather conditions
HorizonEye reserves the right to assess weather conditions and determine whether they are suitable for the performance of the services. This includes but is not limited to wind, rain, fog, and other weather conditions that may affect the safety of the flight.
In the event of adverse weather conditions that may affect the safety or quality of recordings, HorizonEye reserves the right to cancel or reschedule the service. The customer will be informed of the cancellation or rescheduling as soon as possible.
If you cancel due to unfavorable weather conditions, no cancellation fees will be charged. If possible, a new date will be agreed at no additional cost to the customer.
